Tax practitioners have been dealing with departure tax cases for over two decades. Departure tax is the deemed disposition of a person's assets before he or she becomes a non-resident of Canada, resulting in taxation. For the first 23 years of my career, I handled about a dozen such cases. However, over the past nine years, that number has skyrocketed into the hundreds.

Determining whether a person is or will be a non-resident for Canadian tax purposes requires careful analysis. Intentions are not determinative; the facts had better speak for themselves. Therefore, becoming a Canadian tax non-resident requires careful planning. Once a person becomes a non-resident, he is only subject to tax on his Canadian-source income, which includes dispositions of Canadian real estate, employment and operations in Canada, and Canadian-source dividends, royalties and rents.

Personal tax rates in Canada are very high and increasing. Recently, capital gains tax inclusion rates were increased and the alternative minimum tax was revised. These changes have caused many successful individuals to move their capital elsewhere.

Almost all of the files that my colleagues and I have dealt with over the past nine years have involved very proud and patriotic Canadians. Many of them are community leaders and are very charitable, giving both money and time.

During the New Crown Epidemic, the government spent endlessly and lavishly, with articles constantly discussing how to use this time for a “reboot.” Government officials and their supporters continued to put forward radical ideas, such as the possible introduction of a wealth tax, a windfall profits tax and other ridiculous ideas.

The latest attack is on older Canadians who own their own homes and are lucky enough to have capital gains. The government has been currying favour with organizations that believe these older Canadians should pay the home equity tax under certain circumstances. It is clear that the government is exploring many ideas related to increasing tax revenues to support its bloated spending.

As a result, the pace of successful Canadians leaving will continue until the ugly politics, policies and divisive messages subside.
